a) The developer is Darfield Estates Limited Partnership, a New Zealand property development partnership. The directors of the General Partner, Darfield Estates GP Ltd, include Matthew Gilligan (Chartered Accountant) and Peter Montgomery, and have extensive experience, collectively developing over 400 sections.

a) Darfield Estates Stage 1 is across the road from this site, on the eastern side of Telegraph Road. The current release of land represents Stage 2 of the land on Telegraph Road and will have the name ‘Darfield Estates West’ on the entry. Prospective purchasers can drive through Darfield Estates Stage 1 to inspect the wide roads, curb and channel and fencing that the developer produces. Darfield Estates West will have a similar look & feel, with a 3m front yard set back instead of 4m. However many of the streets will also have a central swale, which will be landscaped with trees, shrubs and grass.

a) 5% deposit: Due on signing and satisfaction of purchaser conditions.

b) Additional 5% deposit: Due upon issuance of resource consent (estimated end of September 2025).

c) Deposits are held in the developer’s solicitors’ trust account, with interest accruing to the purchaser. Deposits are refundable in full, including interest, if the subdivision does not proceed.

• DEVELOPER FENCING WITH CHARGE BACK:
One of the issues that arises with new subdivisions is the establishment of fences and the ensuing survey and cost negotiations that result, often at great cost and angst to the landowners. To avoid this, the developer has established the following requirements of purchasers to provide for fencing at minimum cost from the outset.

• Side and Rear Fencing:
The developer will install, at the purchaser’s cost, 1.8m fencing on the side and rear boundaries.

• Key Benefit:
This process is designed to avoid neighbor disputes and arguments over cost responsibilities, ensuring smooth transactions and relationships between purchasers. It significantly reduces the cost of surveying (for fence lines) to the purchasers post-settlement.

• Front Fencing:
Construction of the post and 2-rail fence on the front boundary is left to the purchaser to complete after house construction. Covenants require a simple post and 2-rail fence across the front, as per the sample fence design.
